Is the property owned by whomever the title deed is on?

The claim arising from property ownership and the marital property regime is not the same. The immovable property may remain registered under one spouse's name; if the other spouse has conditions, they can request participation or contribution claims based on the increase in value. Property division does not always result in shares being assigned on the title deed.

If the direct transfer of the immovable is requested, an agreement between the parties or another legally valid basis is required. In most cases, the court's marital property calculation results in a monetary claim.

Time to File a Lawsuit and Protective Measures

The ownership of ordinary household items can be determined according to personal use, purchase documentation, and the agreement of the parties. Separate appraisal may be required for collections, works of art, or high-value movable properties. Considering each small item as the subject of a lawsuit would increase time and costs, so economic value and the possibility of proof are considered together.
