How to Transfer Inheritance?

How to Transfer Inheritance?

Legal guide explaining the stages of inheritance certificate, Web Title application, required documents, tax transactions and post-transfer sharing.

Inheritance transfer is the process of legally linking the deceased person's assets registered in their name with the heirs and recording them in the relevant registries in the name of the heirs. Although ownership is acquired by law with the opening of the inheritance, if a property still appears in the name of the deceased in the land registry, the records need to be updated for the property to be sold, divided, or any other transaction to be made on it.

The transfer process for real estate in Antalya and Manavgat requires the preparation of the inheritance certificate, land registry application, tax procedures, and, if applicable, representation documents in a compatible manner.Lawyer Ahmet Emre Çimen, aims to determine the estate and heir structure in inheritance transfer files first and to ensure that the procedures progress without unnecessary repetition.

Four Questions That Must Be Answered Before Transfer

Which assets does the deceased have?

Title transfer applies only to immovable properties. A separate procedure is conducted at the relevant institution for bank accounts, vehicles, company shares, intellectual property rights, or other receivables. Therefore, the scope of the estate should be determined before starting the process, and it should not be based solely on a known immovable property.

Who are the heirs?

The situation of legal heirs may be different from that of persons who acquire rights through a will or inheritance agreement. The certificate of inheritance shows the persons who will carry out the transaction and their share ratios. In cases of errors in family records, adoption relationships, a deceased heir occurring first, or the presence of a foreign heir, the process of obtaining the document is planned separately.

Has the inheritance been renounced or a dispute arisen?

If there are situations such as renunciation of inheritance, disinheritance, annulment of the will, or objection to the status of heir, the basis of the succession process may be affected. Since registration transactions carried out while the dispute is not finalized may later lead to new lawsuits, the decisions and deadlines in the file should be checked.

Will the transaction be conducted through representation?

One of the heirs or an authorized representative can apply through Web Title Deed. If a power of attorney is to be used, it is important that the inheritance transfer, title deed transactions, and, if necessary, the authorities to share or sell are explicitly arranged. For powers of attorney prepared abroad, additional approval and translation requirements may arise.

Where to Obtain a Certificate of Inheritance?

As a rule, the certificate of inheritance can be obtained from a notary or the civil court of peace. In cases where the population records do not clearly show the inheritance, where there is a foreign element, where there is a dispute in family ties, or where there is a complex situation based on a will, it may be necessary to apply to the court. The certificate determines the heirs and their shares, not the value of the deceased's estate.

If the heir's name, identity information, or share is incorrect in the document, it must be corrected before applying for the title deed. A discrepancy between the deceased's information in the title deed record and the information in the certificate of inheritance can also halt the process. Especially for older title deeds, supportive population records may be requested for differences in name, father's name, and date of birth.

Documents Required for Title Deed Transfer

Among the essential documents announced by TKGM are the identity documents of the parties, a power of attorney if there is representation, or a guardian decision, the original or certified copy of the certificate of inheritance, and compulsory earthquake insurance for properties with buildings. For foreigners, additional procedures regarding the use of foreign documents in Turkey may arise with a passport or relevant country ID.

Information about the property registered in the name of the deceased,

Inheritance document issued by a notary or court,

Identity and, if necessary, tax number information of the heirs,

Power of attorney or authorization document suitable for the transaction, if there is a representative,

Valid DASK policy for immovable properties classified as buildings,

Required approval and Turkish translations for foreign documents.

The list of documents may not be the same in every file. Additional documents may be required if the property is located in a village settlement area, if one of the heirs is restricted, in case of corporate inheritance, or if based on a foreign court decision. Before applying, the title deed record and declaration section should be checked.

Web Title Deed Application and Title Deed Office Stage

One of the heirs can submit a transfer application through Web Title Deed with the required documents. After the application is reviewed, the title deed office notifies if there are missing documents; if the process is deemed appropriate, the revolving fund fee and appointment information are provided. Following signature and identity verification, the property is registered in the names of the heirs according to the shares documented in the certificate of inheritance.

The transfer process does not mean that the heirs have practically divided the property among themselves. If the inheritance partnership continues, the heirs may be seen as joint owners in the land registry. If certain independent sections or properties are intended to be left to specific heirs, a distribution agreement, conversion of joint ownership into co-ownership, or another appropriate procedure may be required.

Tax Procedure is Different from Land Transfer

The inheritance and transfer tax declaration and the transfer in the land registry are not the same process. The declaration is aimed at notifying the tax authority of the inherited estate. The land registry transfer, on the other hand, is the updating of the property owner in the registry. In the TKGM system, the stage at which the tax clearance certificate must be submitted may vary depending on the transaction to be carried out; especially if a sale or division is planned after the transfer, the tax stage should be followed separately.

The deadline for the declaration may vary depending on factors such as the place where the death occurred and the country in which the heirs reside. Since the current deadlines and exemption amounts can change every year, the official data at the date of the transaction should be taken as the basis. The real estate tax value of the property, bank assets, and other estate elements must be reported correctly; the deceased's debts should also be evaluated with supporting documents.

Can a Single Heir Complete the Transfer on Their Own?

It is possible to initiate the registration process on behalf of all heirs upon the application of one of the heirs. However, having the sole heir carry out the transfer does not eliminate the share of the other heirs and does not grant the exclusive right to sell the entire property. In subsequent dispositions, depending on the form of ownership and type of transaction, the participation of all heirs may be required.

This distinction is important in practice. The transaction referred to within the family as 'taking the title in one’s name' is sometimes used merely for inheritance transfer, and sometimes for the transfer of inheritance shares. Signing without clarifying which legal transaction is intended may lead to disputes over value and shares.

Distribution and Sale after Transfer

After the transfer is completed, the heirs can keep the real estate together, rent it out, share it by agreement, or sell it. If a sharing agreement is to be made, the true intentions of all heirs, the values of the real estate, and any previous transfers that may be related to the reserved portion should be evaluated together. If one of the heirs is going to buy the shares of the others, the nature of the transfer and its financial consequences are determined separately.

The existence of a mortgage, lien, annotation of family residence, or other restriction on the property may not necessarily prevent the registration of transfer; however, it affects the heirs' ability to sell and distribute it later. The property tax record at the municipality, the management of the apartment, and subscriptions should be updated independently of the title registration. For properties that generate rental income, proper notification to the tenant regarding the new owner and payment arrangements also reduces potential future disputes over income and eviction.

In the event that an agreement cannot be reached, a lawsuit for the division of the estate or dissolution of the partnership may arise. However, before filing a lawsuit, whether the property is suitable for partition as it is, its zoning status, and the structure and usage of the property should be examined. Division through sale may not be the most economically viable option in every case.

What Problems Can Delayed Transfer Cause?

The fact that the title deed remains in the name of the deceased for a long time does not automatically extinguish inheritance rights; however, practical problems such as the increase in the number of heirs due to new deaths, difficulties with documentation, and inability to manage the property may arise. Property tax, rental income, maintenance expenses, and occupancy claims can become more complicated over time.

Additionally, the relocation abroad, restriction, or death of one of the heirs may require new representation and inheritance documents. Therefore, completing the transfer without delay, especially for real estate planned for sale, rental, or construction, ensures title security.

Inheritance Transfer Tracking in Antalya and Manavgat

The correct order in inheritance transfer is; identifying the heirs, determining the estate, harmonizing the documents, applying for the title deed, and establishing the subsequent disposition plan. Focusing only on the title deed appointment may cause new problems at the tax or division stage.

Attorney Ahmet Emre ÇimenIn the inheritance transfer procedures in Antalya and Manavgat, land registry records, inheritance certificates, foreign documents, and the will of the heirs are evaluated together. If the purpose of the file is not only registration but also division or sale, the legal roadmap should be established accordingly from the beginning.
